On December 2, 2015 the Kentucky Division of Compliance Assistance (DCA) announced a new compliance guide with the goal of helping businesses understand, develop and submit Division for Air Quality (DAQ) permit, registration and no-permit-required applications.

The Air Quality Potential-to-Emit Compliance Guide provides a detailed, plain language, step-by-step walk through of how to perform an environmental compliance evaluation, complete a facility-wide air emission assessment and conduct air emission calculations. The guidance also contains information regarding air quality compliance measures, air contaminant sources and regulatory timeframes for applications. To help individuals navigate some of the unfamiliar terms used, there is a section of definitions that explains many of the technical terms found in DAQ permits and related documents.

The new guidance focuses on the helping entities to develop or identify their potential-to-emit (PTE). PTE is the core component of an air quality application and a way for a facility to numerically show the air quality emissions it can create. PTE is a summary calculation that identifies the maximum amount of air contaminants that can potentially be emitted from the facility. The PTE summary is able to aid in the assessment of applicable requirements and determining if the facility is able to meet those requirements.

DCA is available to help businesses understand potential compliance requirements with state and federal environmental regulations. The Environmental Compliance Assistance Program (ECAP), within DCA, is capable of conducting facility-wide air quality assessments, air emission calculations and complete air quality application forms for small businesses.

A small business, for this purpose, means those that have 100 or fewer employees, are independently owned and operated, and not a major source of air contaminants. The new Air Quality Potential-to-Emit Compliance Guide was created to assist these small businesses, but is designed to be comprehensive and useful to any facility that needs to conduct air emission calculations and request authorization from DAQ.
