The Delaware Department of Natural Resources and Environmental Control (DNREC), Division of Air Quality, amended regulations under 7 DEAC 1141 regarding emissions of volatile organic compounds (VOCs) from consumer and commercial products according to this February 16, 2016 report from Trinity Consultants. The purpose of this rule is for Delaware to adopt revisions to the Consumer Products Model Rules developed by the Ozone Transport Commission (OTC) to further reduce emissions of VOCs to aid in meeting the 8-hour ground-level ozone National Ambient Air Quality Standard (NAAQS).

Delaware is designated as non-attainment for the ozone NAAQS. VOCs contribute to the formation ground-level ozone through the reaction of VOCs and other compounds in the ambient air, particularly on hot, sunny days.

In this final rule, DNREC has added and deleted certain products and product forms listed in the OTC Model Rules, generating 120 regulated products and product forms. The main changes are as follows:

• Many existing products will have their VOC content reduced.
• 10 products have been added to the rule to be regulated for VOC content.
• VOC content limits for 14 existing products for New Castle and Sussex counties (that are currently in nonattainment for the 2008 ground-level ozone NAAQS) have been reduced.
