In October 2014, the Environmental Protection Agency (EPA) issued a report indicating that New York State’s Title V Program had insufficient fee revenue from major stationary sources to cover the annual expenses of the permit program, requiring the program to increase its Title V fees in order to cover the program’s costs. The deficit incurred by New York’s Title V program is partly due to less revenue being generated from the existing fees structure since emissions have decreased from permitted sources.

A final budget agreement increases fees for the Operating Permit Program pursuant to Title V of the Federal Clean Air Act, according to an April 7, 2015 report from Trinity Consultants.

The budget establishes a new annual base fee of $2,500 for all Title V facilities and increases per ton fees on emissions of regulated air contaminants.

Base fees:

• $2,500 for a source subject to state facility permit
• $250 for a source subject to a minor facility registration
• $2,500 for a facility with any other operating approval

In addition to the base fee, facilities emitting regulated air contaminants will also pay increased fees as indicated below:

• Fees for facilities that emit less than 1,000 tons annually are increased from $45 per ton to $60 per ton.
• Fees for facilities that emit between 1,000 tons and 2,000 tons annually are increased from $50 per ton to $70 per ton.
• Fees for facilities that emit between 2,000 tons and 5,000 tons annually are increased from $55 per ton to $80 per ton.
• Fees for facilities that emit 5,000 tons or more annually are increased from $65 per ton to $90 per ton.

These increased fees apply as of January 1, 2015.

What this means to you
Title V Stationary sources in New York will be subject to higher operating permit fees effective January 1, 2015. An annual base for of $2,500 is in effect for all Title V facilities as well as increased per ton fees on emissions of regulated air contaminants.
