Several federal subparts have been incorporated by reference by the Oklahoma Department of Environmental Quality (ODEQ) and became effective September 12, 2014.

Emissions Inventory revises the current emission inventory reporting schedule for all minor source facilities registered under a permit-by-rule (PBR). The rule requires PBR facilities to submit an annual emission inventory for the first calendar year in which the facility is registered. PBR facilities with emissions greater than five tons per year must file an emission inventory every three years and PBR facilities with emissions of five tons or less per year to file an emission inventory every six years. The rule clarifies language and adjusts enforceable requirements and compliance dates consistent with federal requirements.
Air Quality Advisory Council Meeting to discuss NSPS and NESHAP incorporation.
An ODEQ Notice for an October 15, 2014 Air Quality Advisory Council meeting has been published. The meeting will be held in the DEQ Multipurpose Room at 9:00 a.m. DEQ is proposing to incorporate by reference the latest changes to EPA regulations. The meeting’s agenda includes a Public Rulemaking Hearing and presentation regarding DEQ’s incorporation by reference of changes or additions to 40 CFR Part 60, New Source Performance Standards (NSPS) and Part 63 National Emissions Standards for Hazardous Air pollutants (NESHAP).

Oklahoma emissions inventory reporting schedules have been revised for all minor sources registered under a permit-by-rule. Facilities must submit an inventory for the first calendar year registered. DEQ is also holding an October 15 public rulemaking hearing about incorporating EPA changes to New Source Performance Standards (NSPS) and to National Emission Standard for Hazardous Air Pollutants (NESHAP).
