The Air Quality Division of Oklahoma’s Department of Environmental Quality (DEQ) is in the final stages of preparing for the release of a new air permit application option for emergency generator /engines, according to a May 2015 report by Trinity Consultants. The option is for sites whose only need for a permit is because they have an emergency backup generator subject to Federal requirements under NSPS IIII or JJJJ or NESHAP ZZZZ.

The necessary changes to air rules in OAC 252:100-7 will be discussed in an Air Quality Advisory Council Meeting on June 10. The proposed rule change would create a new Permit by Rule (PBR) which would be available around October 2015. The following is a summary of the expected changes that the new permit by rule, once issued, will have:

• It will reduce the requirement to do an Emission Inventory from annually to every 6 years, (after the first year), if site wide actual emissions are less than 5 tpy.
• Annual emissions fees will not be affected by the new permitting format. They are based on the amount of emissions, which will remain unchanged.
• Federal RICE rules and site compliance requirements will remain unchanged.
  • Permitting fees will be reduced. They will match the other Permit by Rule fees already in place, $250 for
• Registration to Construct and $100 for a Registration to Operate.
• Submittal of both fees is acceptable with initial registration.
• Sites with existing or pending applications should be able to convert to this PBR by submitting a letter request to DEQ.
